吉利选择北京起诉长城汽车以恢复名誉

　　在水军事件发酵近20天后，吉利选择了起诉长城。爱卡汽车从北京海淀法院获悉，认为对方恶意传播虚假和误导性信息，损害自己的商业信誉和商品声誉，浙江吉利控股集团汽车销售有限公司以商业诋毁纠纷为由，将长城汽车股份有限公司诉至法院，要求其停止侵权并赔礼道歉。目前，此案已受理。

　　原告吉利汽车公司诉称，2018年10月18日，其发现在今日头条上有名为“吉利公关部经理”的用户在其主页上发布了一则微信群信息的截屏，截屏显示微信群名称为“吉利汽车公关分群5”，内容是要求相关人员注册账号，攻击包括长城汽车在内的国产汽车。鉴于该信息的内容与吉利汽车有关，并且有悖市场规则，影响恶劣，在获悉该信息的当晚，吉利汽车就立即在官方微博上发布题为“假的不能再假，造谣者必受法律严惩！”的声明，对冒用“吉利汽车公关部经理”名义捏造散布虚假信息的行为进行严厉谴责。同时吉利汽车对该信息上用“谣言”字样遮挡，并加盖了公章，以此证明其为虚假信息。吉利汽车发布声明后，始发者删除了该信息，并撤销了“吉利公关部经理”的账号名称。

　　然而，就在涉案截屏信息的影响已经被消除后，2018年10月18日，长城汽车在其以分公司长城汽车股份有限公司徐水哈弗销售分公司名义注册的新浪微博上发布声明，称“吉利汽车虽对此事进行了官方声明，但某品牌拥有海量水军是不争的事实，专门抹黑所有民族自主品牌、粉饰自己、表里不一。”并将涉案截屏信息在其微博上再次发布。

　　尽管警方已发布通报称嫌疑人抓获，但长城汽车以上微博内容被新闻媒体、网站和自媒体多次、大量转载和传播，影响非常恶劣。原告吉利汽车公司认为，长城汽车发布具有明显误导性的微博信息，严重损害了吉利汽车的商业信誉和商品的声誉，已经构成了对吉利汽车的商业诋毁，应当承担相应的法律责任。

　　编辑点评：不仅仅是在汽车行业，大众点评、淘宝刷好评对于商家来说还是有不错的效果。给竞争对手刷一定的差评也是如此，我就吃过一家新开业的、做的不错但点评上只有不到三颗星的餐厅。在冒用“吉利汽车公关部经理”一事发生后，不少中国车企都被卷了进来，只希望这件事儿快速结束吧。
